Moodivate, LLC ("Moodivate," "we," "us," or "our") operates drinkmoodivate.com (the "Site") and sells the Moodivate energy drink mix and related products. We are a small family business based in Willis, Texas, and we treat your information the way we'd want ours treated. This Privacy Policy explains what we collect, why, who we share it with, and the choices you have.

1. Information We Collect

Information you give us: name, email address, phone number, billing and shipping address, and order details when you buy, subscribe, create an account, join our email list, request the Founders' Mix Guide, leave a review, enter a promotion, or contact us (including by calling or texting our phone line).

Payment information: payments are processed by our ecommerce and payment providers (e.g., Shopify Payments, Shop Pay, PayPal, or similar). We do not receive or store your full card number.

Information collected automatically: when you visit the Site, we and our service providers collect device and usage data such as IP address, browser type, pages viewed, referring pages, and cookie identifiers. This is used for site functionality, security, and analytics.

Information from others: if you interact with us on social media or a friend shares your shipping address to send you a gift, we receive that information.

2. How We Use Information

We use your information to: process and deliver orders and subscriptions; manage recurring billing (including retrying failed payments); provide customer support by email, phone, and text; send transactional messages (order, shipping, and subscription notices); send marketing emails and, only with your consent, marketing text messages; request and publish product reviews; improve the Site and our products; prevent fraud and enforce our terms; and comply with law.

3. Text Messages and Calls

If you text or call our published number, we'll use your number to respond. Marketing text messages are sent only with your consent, and you can opt out at any time by replying STOP. Message and data rates may apply. Consent to marketing texts is not a condition of purchase.

4. Who We Share Information With

We do not sell your personal information for money, and we do not share it with unrelated third parties for their own marketing. We share information only with service providers who help us run the business, under contracts that limit their use of it, including: our ecommerce platform (Shopify); payment processors; fulfillment and shipping partners (our fulfillment provider and carriers such as USPS/UPS) who receive your name and address to deliver orders; subscription management, email, review, and communications providers; and analytics or advertising services if and when we use them (see Section 6). We may also disclose information if required by law, to protect our rights or the safety of others, or as part of a business transfer.

5. Cookies

The Site uses cookies and similar technologies for core functions (cart, checkout, login), performance, and analytics. You can control cookies through your browser settings; blocking some cookies may break checkout.

6. Advertising and "Sharing" Under State Law

If we use advertising pixels or retargeting in the future (e.g., Meta or Google), that activity may be considered "sharing" or "targeted advertising" under some state privacy laws. Where required, we will provide an opt-out mechanism, and you may also opt out now by emailing us at team@drinkmoodivate.com with the subject "Ad Opt-Out."

7. Your Privacy Rights

Depending on your state (including under the California Consumer Privacy Act as amended, and similar laws in Texas, Virginia, Colorado, Connecticut, and elsewhere), you may have the right to: know what personal information we hold about you; access a copy of it; correct it; delete it; opt out of targeted advertising or "sales/sharing"; and not be discriminated against for exercising these rights. We will verify your request (usually by confirming control of the email on file) and respond within the time required by law. You may use an authorized agent where permitted; appeals may be sent to the same contact marked "Privacy Appeal."

8. Data Retention and Security

We keep order and account records as long as needed for the purposes above and to meet legal, tax, and accounting requirements, then delete or de-identify them. We use reputable providers and commercially reasonable safeguards, but no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. Children

The Site and our products are intended for adults. The Site is not directed at children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us and we will delete it.

10. Do Not Track

Our Site does not currently respond to browser Do Not Track signals. Where state law requires recognition of universal opt-out signals (such as the Global Privacy Control) for sharing/targeted advertising, we honor them to the extent applicable.

11. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date shows the latest revision, and material changes will be posted on this page. Your continued use of the Site after changes take effect means you accept the updated policy.
